Sanibel City Council members raised questions and concerns Tuesday over proposed changes intended to more clearly define an “open body of water” in the Sanibel Code and, by consensus, moved the discussion to the November meeting.
Councilwoman Holly Smith said the proposed changes were “confusing” to her and, therefore, could deter property owners. She pointed to a few areas of concern and requested more time to review the proposed amendments more thoroughly.
“I honestly believe there can be some tweaks to make this better,” said Smith. “I don’t think it will hurt us to take a little more time to get it right.”
Mayor Richard Johnson agreed. “I would rather take action that is correct and appropriate than quick,” he said. “I think it has sparked more questions than answers for me.”
Defining an open body of water is an essential aspect of land development on the island since its presence and size within a parcel may affect the development intensity and site design.
The planning commission and city staff have worked on the proposed changes since April 2022, when the council tasked them with reviewing it. The intent was to define an open body of water more clearly and ensure references to it in the Code are understandable.
Commissioners passed a resolution on their recommendations in September with a 5-1 vote, with Commissioner Ken Colter opposing it.
