Planning Commission Rules on Appeal

by SC Reporter Emilie Alfino

The Planning Commission on April 22 considered a resolution relating to the appeal of construction of a single-family home on property owned by William and Sunyoung P. Covaleski and located at 1305 Seaspray Lane.

Resident Arlene Dillon gave a thorough presentation at the April 8 commission meeting when the appeal was presented. The appellant’s written appeal, while focused on the boundaries of an open body of water on the subject property, provided sufficient notice to the city that they were challenging all the floodplain administrator’s decisions and determinations. Appellants raised significant additional arguments of alleged error.

The commission made one change to the resolution. Where it reads, in Whereas #6, “the Planning Commission found the floodplain administrator erred in its requirements, decisions or determinations …” The Commission amended this to state, “the Planning Commission found the floodplain administrator MAY HAVE (emphasis added) erred in its requirements, decisions or determinations …”

Once amended the resolution passed unanimously 6-0 with Commissioner Ken Colter recused as he is the builder of the subject home. It will now proceed to City Council.
