Solar, Electrical Power Ordinance Goes Back to Planning Commission

The Sanibel City Council members on Tuesday, Oct. 21, discussed an ordinance that would create an administrative waiver process for exemptions from the impervious coverage and developed area requirements for solar energy systems, electrical power generators, and HVAC systems. The ordinance will also create a new rule for accessory stairs and platforms to elevate electrical and mechanical equipment.

Savannah White, Senior Planner, wrote in a memo that, “These amendments support renewable energy adoption by making it easier to install solar batteries and associated equipment and by simplifying permitting through the administrative deviation process.”

Council Member Richard Johnson wants to include swimming pool equipment. He also said this legislation “is the right thing to do at this time for the resilience of the community.”

Vice Mayor Holly Smith said everybody is looking to elevate everything they can. She wants older, nonconforming construction to be subject to the same rules as new construction.

“Any equipment that we can elevate is going to get people back in their homes more quickly,” she said. “These aren’t ‘want’ to haves, these are ‘have to’ haves.”

This matter may have to go to a referendum if it amounts to allowing increases in developed land or impermeable coverage. The proposed ordinance will go back to the Planning Commission for reconsideration.
